The Legal Aid Center of Southern Nevada has noted a spike in cases involving the placement of liens on homes for unpaid trash bills, describing the situation as distressing for clients who not only struggle to pay what they owe but also face overwhelming attorney fees that can escalate the total debt significantly. For many, the threat of foreclosure looms larger than ever, with some residents expressing anxiety over potentially losing their homes.

Since 2020, Republic Services has commenced foreclosure proceedings against nearly 150 homes due to unpaid trash bills, with most customers owing less than $5,000. That figure dramatically increases when including added attorney fees, which can inflate the total debt to several thousand dollars. Between 2018 and 2020, foreclosure lawsuits against homeowners increased significantly, indicating a troubling trend for low-income households.

Legal records highlight that Republic Services has placed over 99,000 individual property liens from March 2020 to March 2021. The average charge for residential trash pickup service is less than $20 a month, but the additional costs associated with liens can exceed $300 for unpaid bills. Furthermore, due to the “super priority position” of these liens, they are prioritized in foreclosure sales, often taking precedence over mortgage payments.

Some residents have reported successfully negotiating settlements before reaching the point of foreclosure, yet many find themselves navigating a complex legal system after liens have already been filed, making resolutions more difficult. Local resident Rose Parker, struggling with a bill of approximately $1,850, expressed concern over losing her home that she has owned for over 25 years.
